Terms of Use

These Terms of Use (“Terms”) govern your access to and use of HornostAI (“HornostAI”, “we”, “us”) — the AI sales agent and management console available at hornostai.com and console.hornostai.com (together, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. The Service
HornostAI provides an AI agent that communicates with a business’s customers across messaging channels (Instagram, Telegram, WhatsApp, Viber and an embeddable web widget), answers from the business’s catalog, captures orders, creates Nova Poshta shipments, and helps accept payments — together with a console to configure and monitor it. Features may evolve over time as we improve the Service.
2. Accounts & eligibility
- You must be at least 18 years old and able to enter a binding contract.
- You are responsible for the accuracy of your account information and for keeping your credentials and API keys secure.
- You are responsible for all activity under your account, including that of your team members and operators.
3. Your responsibilities
When you use HornostAI to communicate with your customers, you agree to:
- use the Service lawfully and only for legitimate business communication;
- comply with the terms and policies of the underlying platforms (Meta/Instagram, WhatsApp, Telegram, Viber) and of payment and delivery providers;
- obtain any consents required to message your customers and to process their personal data, and provide them with required notices;
- keep your catalog, prices, promotions and business information accurate;
- act as the data controller for your customer conversations, with HornostAI acting as a processor on your behalf (see the Privacy Policy).
4. Acceptable use
You must not, and must not allow others to:
- send spam, unsolicited bulk messages, or content that is unlawful, deceptive, harmful, or infringing;
- use the Service to sell prohibited or illegal goods or services;
- reverse-engineer, disrupt, overload, or attempt to gain unauthorised access to the Service or its infrastructure;
- misrepresent the AI as a human where doing so is unlawful, or use it to mislead or defraud customers.
5. Third-party services
The Service integrates with third parties — including Meta (Instagram, WhatsApp), Telegram, Viber, Nova Poshta, and payment providers such as Monobank and LiqPay. Your use of those services through HornostAI is also subject to their own terms and policies. We are not responsible for third-party services, and their availability or changes may affect the Service.
6. AI-generated content
The agent generates responses automatically and may occasionally be inaccurate or incomplete. You are responsible for configuring, reviewing, and supervising the agent’s behaviour, and you can take over any conversation or disable the agent at any time. You are responsible for the messages sent on your behalf.
7. Plans, trial & billing
- We offer a free trial and paid subscription plans priced by conversation volume. Details are shown in the console and on our pricing page.
- Paid plans are billed in advance for the applicable period. Usage above your plan’s included volume may incur overage charges as disclosed.
- Except where required by law, fees are non-refundable. You may cancel at any time; access continues until the end of the current billing period, after which the account may revert to a limited free tier.
- We may change prices or plans on reasonable notice; changes do not apply retroactively to a period already paid.
8. Intellectual property
HornostAI and its software, design, and trademarks are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of your own content — your catalog, business data, and customer conversations — and grant us the rights needed to operate and provide the Service.
9. Data protection
Our handling of personal data is described in the Privacy Policy, which forms part of these Terms. For customer conversations processed on your behalf, you are the controller and we are the processor.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or fit for a particular purpose. Nothing in these Terms limits rights that cannot be limited under applicable consumer law.
11. Limitation of liability
To the maximum extent permitted by law, HornostAI will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us, other users, or third parties. On termination, your right to use the Service ends; certain provisions (such as intellectual property, disclaimers, and liability) survive.
13. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page with the “Last updated” date above. If we make material changes, we will provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which HornostAI is established, without regard to conflict-of-law rules, and subject to any mandatory consumer protections available to you where you reside.
